“A Apple está atacando primeiro as empresas asiáticas, depois poderá ir atrás da Motorola e ir talhando gradualmente a base da Google. Ela quer barrar o tsunami do Android”, diz advogado especializado em patentes.

 

“A Apple tem confiado em belas aplicações e em ainda mais belas propagandas para promover o iPhone e manter sua vantagem sobre rivais como a Google na batalha pelo domínio da próxima geração de smartphones. Mas essa batalha pode acabar se tornando em algo mais provinciano: quem tem os melhores advogados. Nesta terça-feira a Apple abriu processo judicial contra a HTC, empresa de Taiwan que é a maior produtora de smartphones rodando o sistema operacional Android, da Google Inc., incluindo o Nexus One, projetado e vendido pela Google”, diz Brad Stone no site do jornal The New York Times.

Protocolado no escritório do International Trade Commission — órgão do governo americano similar à Secretaria de Comércio Exterior do Ministério do Desenvolvimento, Indústria e Comércio — e na corte distrital federal do Estado de Delaware, o processo traz a alegação da Apple de que os celulares HTC rodando Android violam 20 de suas patentes, incluindo as relacionadas à capacidade do iPhone de reconhecer o toque simultâneo de múltiplos dedos na tela, diz Stone.

“Embora a ação tenha a HTC como alvo, muitos analistas e advogados especializados em patentes dizem crer que o verdadeiro alvo da Apple é a Google e o sistema operacional Android, que a empresa distribui para os fabricantes de celulares”, observa Stone.

“O processo ‘é o primeiro tiro de uma guerra’, disse Kevin Rivette, advogado de patentes e ex-vice presidente de estratégia de propriedade intelectual da IBM. ‘A Apple está atacando primeiro as empresas asiáticas, depois poderá ir atrás da Motorola e ir talhando gradualmente a base da Google. Ela quer barrar o tsunami do Android'”, relata Stone.

“A Apple, com seu portfolio de patentes relacionadas a controles multitoque e outras formas de operar esses complexos aparelhos, aparentemente acredita ter o embasamento legal necessário para frear a Google e a disseminação do Android. (…) Tal como acontece em qualquer caso envolvendo patentes, uma decisão ou acordo pode depender da possibilidade de os advogados da HTC — e talvez da Google, se ela decidir ajudar — conseguirem provar que as inovações demonstradas pela Apple não eram novidade”, diz Stone.

    De uma coisa todos podem ter certeza: a Apple não processaria a HTC sem ter plena confiança em sua posição legal. A ação pretende abrir precedentes legais para futuras ações similares.

    Penso também que concorrência é algo salutar, desde que se respeite a propriedade intelectual alheia. Há quem diga que pelo menos uma das patentes da Apple usadas na ação poderá ser facilmente invalidada, mas ainda há as outras 19. Bastaria que umas 10 fossem julgada válidas (e alguém aqui duvida que sejam?) para por fim à aventura de Google/HTC.

Initially, a “proxy” object is created in the same process as a sender object. This proxy acts as a local receiver for all objects in the local program. When the proxy receives a message, the message is encoded and transmitted between programs as a stream of bytes.       Lá vem mais um querer comparar uma empresa falida de idéias, e decadente, como a Nokia, com a Apple.
      Pense um pouco antes de querer estabelecer comparações estapafúrdias.
